Il presente saggio si muove all’interno di un panorama comparatistico delle strutture europee e statunitensi che stabiliscono e coordinano i vari standard. Vi si affrontano il recente sviluppo e le emergenti politiche interne a questo ampio settore, e altresì gli effetti che ne seguono per la disciplina volta alla protezione del consumatore, nonché a quella della concorrenza. Nel saggio vengono altresì presentati i risultati, gli ostacoli e le sfide dei processi di armonizzazione degli standard, anche alla luce dei recenti sviluppi nel settore, come la negoziazione del TTIP (Trattato transatlantico sul commercio e gli investimenti). Non manca poi un riferimento specifico alle principali organizzazioni mondiali impegnate nella definizione degli standard con il fine precipuo di superarne i punti critici e raggiungere, nel processo di standardizzazione, importanti obiettivi. Vengono inoltre prese in considerazione le modalità attraverso le quali, nel sistema statunitense ed europeo, i problemi relativi alla protezione del consumatore sono influenzati dall’applicazione di leggi sulla concorrenza nelle materie regolate da standard. Infine, sempre in un’ottica comparativa, viene brevemente affrontato il problema della eventuale responsabilità civile dei soggetti preposti alla definizione degli standard.

This Essay is set within the comparative context of EU and US legal structures that establish and coordinate standards. It considers their recent development and the underlying policies within this broad field, and the effects these regimes have on laws regarding consumer protection and their relevance to competition law. It reveals the achievements, obstacles and challenges of harmonizing standardization processes, also in light of recent developments in this field, such as the negotiations of the Transatlantic Trade and Investment Partnership (TTIP). It also provides an overview of the main standard-setting organizations working worldwide in order to achieve a number of goals, to deal with some critical aspects and support the standardization process itself. It also reviews the various ways by which, in both the EU and the US, consumer-protection issues are influenced by the application of competition law to matters involving standards. Last, it touches on – again in a comparative light – the issue of standard setters’ potential tort liability.

Rebecca SpitzmillerRebecca Spitzmiller insegna Diritto comparato e internazionale all’Università degli Studi Roma Tre. Ha iniziato la carriera come insegnante d’arte nelle scuole media statali negli Stati Uniti. Dal 2009 si impegna nelle attività di Retake Roma, finalizzate alla diffusione di un comune sentire intorno ai principi della sussidiarietà (articolo 118 Cost.), con specifico riguardo alla promozione della partecipazione dei cittadini nella cura dei Beni Comuni. Rebecca ha la doppia cittadinanza italiana e statunitense da oltre 20 anni, e cerca di trarre il meglio dai due mondi, al fine di combattere – tramite il concetto di “empowerment” (cioè la creazione di cittadini autonomi e responsabili) – il degrado urbano e promuovere la creatività riconosciuta dalle istituzioni pubbliche e private..


Rebecca Spitzmiller is an Adjunct Professor in International Business Contracts and a Researcher in Comparative Law at Roma Tre University. Her publications include «A Primer on Competition and IP Law: A US–EU Perspective on Private Enforcement» in Intellectual Property Rights and Competition Law (Kluwer Law International, 2012), a book she co-edited, and «Selected Areas of Italian Tort Law: Cases and Materials in a Comparative Perspective» (il Sirente, 2010). Other areas of research and publications have focused on comparative aspects of Family Law and Freedom of Assembly. Since 2009 she has coordinated Studying Law at Roma Tre, a program offering some twenty courses and seminars yearly in law in English, a dual law degree program with Nova Southeastern University and semester abroad opportunities in the US, China and Australia.
